Terms of Service

These terms are between you ("you", "your") and Fanel Limited ("Fanel", "we", "us"), a company registered in Kenya. Registered office: Nairobi, Kenya. Contact: info@fanel.co.ke

By creating a Fanel account, you agree to use the platform in accordance with these terms and all applicable Kenyan laws, including the Data Protection Act, 2019 and the Kenya Information and Communications Act (Cap 411A).

1. Your Account

You are responsible for keeping your login credentials secure. You must not share your account with others or use Fanel for unlawful purposes.

2. Subscriptions and Billing

Subscription fees for Fanel plans are billed in KES through IntaSend by M-Pesa STK Push or card, either monthly or annually as selected at signup. Each paid plan includes a monthly allowance of documents, AI emails, and prospects. Document Packs and pay-as-you-go single-document purchases are billed separately as one-time payments at the time of purchase.

You may cancel your subscription at any time from your Billing page. Your plan remains active for the billing period you have already paid for. Refund eligibility is governed by applicable Kenyan consumer-protection law; contact info@fanel.co.ke for refund or billing reconciliation requests.

If a per-document payment succeeds but document generation fails, the charge is automatically refunded within 60 seconds. If you do not see the refund within 5 minutes, contact info@fanel.co.ke with your M-Pesa transaction reference.

3. Your Data

You own the data you enter into Fanel. We do not sell your data to third parties. See our Privacy Policy for full details on how we handle your information.

4. Service Availability

We aim for high availability but do not guarantee uninterrupted service. We are not liable for losses arising from downtime or technical issues.

5. Limitation of Liability

To the maximum extent permitted by Kenyan law, Fanel's total liability to you for any claim arising from these terms or your use of the service shall not exceed the total fees paid by you in the 12 months preceding the claim.

6. Changes to These Terms

We may update these terms from time to time. We will notify you of material changes by email at least 14 days before they take effect. Continued use of Fanel after changes are posted means you accept the updated terms.

7. Governing Law

These terms are governed by and construed in accordance with the laws of the Republic of Kenya.

8. Dispute Resolution

Any dispute arising from these terms shall first be resolved through good-faith negotiation between the parties. If unresolved within 30 days, the dispute shall be referred to mediation under the Nairobi Centre for International Arbitration (NCIA) rules. The place of mediation shall be Nairobi, Kenya.
